Contract Administration Essentials: Effective Contract Management for Best Practice

Overview

This CPD session will explore the essentials of contract administration, from the specifics of contract management to risk and claims management. By the end of this session, architects and designers will be better able to ensure that contractual commitments and obligations are efficiently met, by delivering value for money and managing inherent risk.  

 

NSCA 2021 Performance Criteria

This session will deliver outcomes related to the following Competencies from the 2021 National Standard of Competency for Architects:

PRACTICE MANAGEMENT AND PROFESSIONAL CONDUCT

  • PC1: Understand the regulatory requirements and obligations pertaining to practice as an architect, including professional codes of conduct and obligations for continuing professional development and professional indemnity insurance. 
  • PC16: Understand risk management and mitigation principles and strategies – including safety in design, project risk, requirement for resilience from the impacts of climate change and appropriate insurances – across architectural services.

DESIGN DELIVERY AND CONSTRUCTION PHASE SERVICES 

  • PC57: Understand the principles of contract administration, including certification, variations, instructions, requests for information and practical completion. 

 

Learning Outcomes

At the end of this session participants should be able to:

  • Explain the principles and responsibilities of contract management, including its definition, purpose, and administration requirements.
  • Apply foundational risk management processes, includingidentifying, assessing, and treating risks; understanding risk categorisation and likelihood; and using a standard risk management matrix.
  • Apply claims management processesincluding managing claims and dealing with contract variations such as time extensions, delay costs, and defective material or work.

 

Speaker

Scott Alden

With over 25 years’ experience, Scott specialises as a legal advisor on significant projects and procurements for private and government clients.

Scott’s role of lead advisor to significant projects often incorporates legal and procurement expertise on the same transaction, as well as strategic probity advice. 

In recognition of his position as a leading government and lawyer, Scott was one of the first Law Society Accredited Specialists in Government and Administrative Law, both Commonwealth and State (with a focus on government commercial and procurement transactions), and has been appointed by the Law Society of NSW as the Head Assessor for that Specialist Accreditation. Scott also writes and lectures two procurement courses for the Masters Programs at both College of Law and the University of Melbourne. Scott is further well-experienced in commercial matters related to construction.

He is experienced in drafting and implementing key project documents including market sounding/engagement documents, industry briefings, RFTs, tender evaluation plans, tender evaluation reports, commercial contracts and agreements and legal advice and resolutions to support decisions.
