Overview

This comprehensive CPD event will breakdown the most effective approaches and skills you can bring to the bargaining table at each phase of the contract negotiation process. Led by business acumen consultant Cyril Jankoff, our program will provide a comprehensive overview of the key commercial and legal considerations when entering contract discussions, and present all the tools you need to leverage your position and become a more successful contracts negotiator.

CPD

This presentation is equivalent to 3 total hours/points of formal CPD and will deliver outcomes related to the following Competency/s from the National Standard of Competency for Architects: 

Practice Management and Professional Conduct
PC 1: Understand the regulatory requirements and obligations pertaining to practice as an architect, including professional codes of conduct and obligations for continuing professional development and professional indemnity insurance.
PC 5: Understand the essential elements of a client architect agreement, across the range of procurement methods and the different scales and types of project.
PC 6: Understand appropriate processes for reporting and varying the scope of services provided by an architect. 
PC 7: Understand appropriate processes for clear and consistent communication with clients and relevant stakeholders throughout a project, including obtaining approvals from clients and stakeholders. 
PC 9: Understand contemporary and emerging building procurement methods. This involves identifying the most appropriate form of delivery for a project, including associated risks, mitigation and adaptation strategies, and understanding appropriate construction and consultant contracts and agreements.
PC 15: Understand legal and ethical obligations relating to copyright, moral rights, authorship of cultural knowledge and intellectual property requirements across architectural services.

PC 57: 
Understand the principles of contract administration, including certification, variations, instructions, requests for information and practical completion.

Learning Outcomes

At the end of this session participants should be able to:

  • Understand key negotiation legal issues
  • Negotiate internal and external agreements and variations
  • Explain the relationship between contracts and negotiations
  • Identifying ways to eliminate as many risks as possible before agreeing contracts
  • Enact key behaviours and understand various styles in the negotiation process
  • Demonstrate awareness of the four key phases in negotiation
  • Differentiate strategic and transactional negotiations

Cyril Jankoff

Cyril has practiced as an accountant, solicitor, business consultant and financial controller in diverse industries throughout his 30 year career. He is a business improvement and acumen trainer and consultant. Cyril’s qualifications and expertise in law, accounting, general management, contract management and education has given him a multi-perspective approach in consulting on how to improve your organisation’s contract management capabilities and training and mentoring your staff to improve their commercial contract management knowledge and skills, particularly in relation to the area of negotiations, and the risks that affect contracts and variations.
