The Code of Novation: an industry-wide framework for quality procurement

Overview

We all know first-hand the challenges facing our industry in the pursuit of delivering a high-quality built environment. In the face of high-profile examples of construction defects and the 2018 Shergold Weir Building Confidence report, the Australian Institute of Architects identified procurement as a key policy priority. 

Following a National Novation Survey in December 2018 to understand the experience of architects, the Institute undertook an industry-wide consultation process to develop and refine the Code of Novation which was published in March 2022. 

The Code of Novation is an industry-wide framework defining standards of conduct for novated design & construct projects that promote good design, safety and quality standards throughout the entire procurement process, thereby mitigating project risk and resulting in significant benefits to the built environment, and the broader community.

David Wagner is the Victorian Chapter President and has been a Councilor of the Victorian Chapter of the Australian Institute of Architects, co-chair and member of the Medium Practice Forum, and member of small practice forums. He was also on the Victoria/Tasmania Branch committee of the Association of  
Consulting Architects, as Secretary and chair of its IR committee. David was made a Fellow of the Australian Institute 
 of Architects in 2013. 

David is a partner of the architectural studio Atelier Wagner. With over 30 years of experience as an architect, David has a wealth of experience in small, medium and large practices in Melbourne, Canberra and London. David has a strong belief in the great value architecture brings to society and is particularly interested in how government policy settings can support better design outcomes while contributing to a more sustainable, enjoyable and healthy built environment..

JEREMY SCHLUTER

Senior Associate, Hassell

Jeremy has a wealth of experience across diverse projects, specialising in large-scale, complex projects.   
He is a passionate architect and the global sector co-leader for Residential at Hassell with 20 years of   
professional experience. He has worked across a range of typologies, scales and geographies as well as   
contributed to our profession through advocacy, industry bodies and academic engagement.   
Jeremy served on the Victorian Chapter Council in 2020 and 2021 during which time he chaired the   
Victorian Large Practice Forum (LPF) and led the industry-wide Code of Novation consultation which was   
published in March 2022.

  • Define novation as a procurement strategy and articulate its benefits and risks
  • List the key aims of the Code of Novation as a guide and industry framework
  • Identify the parties to novation and understand their roles and responsibilities within the novation context
  • Describe the Code's communications protocols, value management, client relationships and the independence of the superintendent role during the construction phase
  • Apply the Code of Novation in your professional activities

This presentation is equivalent to 1 hour/point of formal CPD and will deliver outcomes related to the following Competencies from the National Standard of Competency for Architects:

2021 NSCA PERFORMANCE CRITERIA

This presentation is equivalent to 1 hour/point of formal CPD and will deliver outcomes related to the following Competencies from the National Standard of Competency for Architects:

Practice Management and Professional Conduct
PC5 
Be able to apply essential elements of a client architect agreement across the range of procurement methods in relation to their appropriateness to the scale and type of the project, including alternatives for partial services and the engagement of secondary and sub-consultants.
PC 9 Demonstrate understanding of contemporary and emerging building procurement methods. This involves identifying the most appropriate form of delivery for a project, including associated risks, mitigation and adaptation strategies, and integrating appropriate construction contracts and consultancy contracts and/or agreements.
PC 13 Be able to identify and apply strategies, programming and processes for documentation through all project stages to facilitate project delivery, as appropriate to selected procurement processes. 
PC 14 Be able to identify and apply construction services provisions and/or construction administration systems needed to fulfil all obligations appropriate to the procurement process in accordance with the terms of the agreement.

Detailed Design and Construction Documentation
PC38 
Be able to work within budget and time constraints while maintaining the defined project design intent. This includes participating in value management processes where engaged to do so.

Be able to coordinate and integrate input from specialists and consultants into the detailed design and documentation.

Be able to produce project documentation that meets the requirements of the contract and procurement process and complies with regulatory controls, building standards and codes, and conditions of construction and planning approvals.

Design Delivery and Construction Phase Services

Be able to apply the principles and mechanisms implicit in the selected procurement method and associated construction contract(s), based on an understanding of the implications of differing contractual relationships.
