OVERVIEW

Isabel Legge from the ARBV will discuss various key topics and how they relate to the core professional obligations.
Topics include:

  • Introduction to the ARBV and what we do
  • Architect’s base obligations with Registration & Renewal requirements
  • Prohibited conduct vs professional conduct
  • Supervision requirements under the act
  • Obligations as a director of a company/partnership
  • Adhering to other acts: Competitions & Consumer Act, Fair work & Building act
  • Obligations under the Architects Regulations 2015, Schedule 1 - Code of Conduct including:
    -  Architect Services, Client Relations and Architectural Practice
    -  Approved partnerships and approved companies
    -  Duties to the public and the profession
    -  Obligation to comply with the guidelines of the board

 Joe Zita (Director Approval Systems) will discuss the relationship between architects, building designers and building surveyors in the building permit process and what good practice/interaction looks like.

Topics include:

  • What is required of building designers to satisfy the requirements of the Building Act with respect to the building permit process
  • Current practice
  • Influencing factors
  • Active regulator (VBA), Proactive inspection program, Building permit audits.
  • Building Surveyor Code of Conduct (introduced Jan 2021) and implications on building surveyors issuing building permits in breach of Section 24 of the Act
  • Separation of statutory functions (relevant Building Surveyor) from consulting activities.
  • Introduction of VBA Design Standards Guideline (Aug 2024)

Architect and Former Victorian Premier Ted Baillieu will discuss his role in addressing the combustible cladding crisis following the Grenfell Tower fire of June 2017. The fire highlighted the severe risks associated with combustible cladding, leading to significant government action.

Topics outlining the initial response to:

  • The fire, including emergency measures and the investigation into its causes.
  • Details on the creation of Cladding Safety Taskforce, an agency established to manage the cladding rectification process and other systemic defects identified in the course of the Cladding Audit. 
    CST's objectives include overseeing:

      - The removal of unsafe cladding, supporting affected building owners
        and enforcing new safety regulations

      - Review the legislative and regulatory reforms introduced to address
        these issues including changes to building codes & compliance standards

      - Reflect on the challenges and successes of implementing these reforms,
        sharing personal insights and lessons learned.

 

CPD

This presentation is equivalent to 1 total hour/point of formal CPD and will deliver outcomes related to the following Competencies from the National Standard of Competency for Architects:

PRACTICE MANAGEMENT AND PROFESSIONAL CONDUCT

PC 1 - Comply with the regulatory requirements and obligations pertaining to practice as an architect, including legislation, professional codes of conduct, obligations for continuing professional development and professional indemnity insurance.
PC 2 - Implement practice resources and apply ethical employment practice methods and quality assurance systems to facilitate efficient, consistent and timely delivery of architectural services.

PC 11 - Be able to assess, recommend and/or select an appropriate procurement process, with consideration for its impact on all phases of a project – including design, documentation and project delivery – and provide advice to the client in terms of the level of scope of service for consultants.
PC 12 - Provide independent, culturally responsive and objective advice in accordance with relevant building codes, standards, technical specifications and guidelines, and planning regulations, including climate change implications, across all aspects of architectural practice.

PROJECT INITIATION AND CONCEPTUAL DESIGN
PC 20 -
Be able to assess project budget and time frame against project requirements and objectives, relevant legislation, statutory planning requirements, building codes and standards.
PC 23 - Be able to prepare a return brief for approval by the client and relevant stakeholders in response to a client brief and any areas of deviation or non-compliance.
 

DESIGN DELIVERY AND CONSTRUCTION PHASE SERVICES
PC 56 - Be able to apply appropriate and consistent systems for identification of defects, rectifications and approval of substitutions.
                                                                                                                                                      

Learning Outcomes

At the end of this presentation you should be able to: 

  1. Identity architects’ professional obligations under the Architects Act 1991
  2. Explain the prohibited conduct provisions under the Architects Act 1991
  3. To provide an insight into what constitutes acceptable documentation for building permit applications resulting in:
    • Minimising delays in obtaining building permits,
    • Fewer defects on site
    • Reducing professional liability for architects and building surveyor
  4. Introduce the VBA Guidelines for documentation standards and what they mean for designers

Isabel Legge - Registered Architect / Principal Advisor Architect at the ARBV

Isabel is the Principal Advisor Architect at the Architects Registration Board of Victoria, and a registered architect at FIGR architecture and design. She brings over 15 years of experience in architecture, spanning from small home alterations and additions, to newbuilds, to large-scale public and commercial projects. Her role at the ARBV allows her to merge her love for quality architecture with helping to improve the standards of the profession and its standing in the community. www.arbv.vic.gov.au

 
The Hon Ted Baillieu AO
Ted Baillieu is a Victorian architect and former Premier of Victoria, serving from 2010 to 2013. With a distinguished career in architecture, Baillieu is renowned for his contributions to urban planning and building design. He is a Life Fellow of the Australian Institute of Architects and an Adjunct Professor at Swinburne University School of Design, and Melbourne University's Honorary Enterprise Professor associated with the Faculty of Architecture, Building & Planning. His tenure as  Co-Chair of the Victorian Government’s Cladding Task Force (2017-2019) was marked by significant policy initiatives including addressing the combustible cladding crisis and other systemic defects identified in the course of the Cladding Audit following the Grenfell Tower fire. Baillieu played a pivotal role in the establishment of the Cladding Safety Taskforce, aiming to rectify safety issues and enhance building regulations. His leadership in both the architectural and political spheres has left a lasting impact on Victoria’s built environment and safety standards.


 
Joe Zita – Founder and Director of Approval Systems 
Joe is the founder and Director of Approval Systems, a building surveying practice which he established in 2002 and which has evolved into one of Victoria’s leading building surveying practices.  

Joe is passionate about maintaining high standards within the profession and ensures that Approval Systems provides its clients with the personal and quality service on simple and complex projects, including high level compliance strategies to government agencies.  

Joe is a strong advocate for the profession when the opportunity arises. His experience spans a career of 35 years, including three years at an international fire engineering and testing organisation. Joe was also a member of the Victorian Chapter Committee of the AIBS and until recently was a long serving member of the Building Appeals Board where he was been involved with significant landmark cases including protection of adjoining property, siting, cladding and building control administration matters.
