Overview

On the 10 year anniversary of the first edition of the Australian Building Industry Contracts (ABIC), the joint authors Australian Institute of Architects and Master Builders’ Association have revised the contracts and are launching improved editions of Major Works, Simple Works (commercial and domestic) and Basic Works (commercial).

This seminar will examine the new contract provisions and mechanisms in detail, how to administer these, as well as looking at the supporting guidance materials and templates available to users of the new contracts.

CPD

This presentation is equivalent to 2 hours/points of formal CPD and will deliver outcomes related to the following Competency/s from the National Standard of Competency for Architects:

Project Delivery: Procurement
7.1 Identification of available procurement methods and assessment of relevance and application to the project.
7.3 Selection of procurement method incorporates assessment of the impact on contractual arrangements between all project stakeholders.

Project Delivery: Construction Stage
8.1 Selection process for appropriately qualified contractors is in accordance with procurement method and project contract.
8.5 Identification and application of all relevant processes required for certification of monetary claims, project variations, extensions of time, project instructions or other administrative responsibilities under the contract provisions.

 

Learning Outcomes

At the end of this session participants should be able to:

  • Identify the new provisions and mechanisms in ABIC MW, SW and BW commercial and domestic contracts.
  • Understand their role and obligations in administering these new mechanisms and related timeframes.
  • Develop an understanding of how current industry practices may affect administration of the ABIC contracts.

    Dean has authored the ABIC and Institute contracts, their supporting documents and related practices resources on Acumen. Dean has a legal background in property, planning, construction and insurance claims. Dean is legal counsel at the Institute and Director of Legal Advisory and Governance.
