This module introduces the various types of building contracts and aspects to consider when selecting which contract to use. It will then cover providing advice to clients and how they may be included in tender processes and the issues likely to be faced when administering the contract.

 

CPD

This presentation is equivalent to 1 hour/point of formal CPD and will deliver outcomes related to the following Competency/s from the National Standard of Competency for Architects:

    2015 Competencies:

    Design: Project Briefing

    1.5 Knowledge of different procurement processes available and evaluation of the impact these have on the project

    Project Delivery: Procurement
    7.1 Identification of available procurement methods and assessment of relevance and application to the project
    7.3 Selection of procurement method incorporates assessment of the impact on contractual arrangements between all project stakeholders
    7.6 Knowledge and application of all administration and principles for the selected procurement method and associated contracts


    Project Delivery: Construction Stage
    8.1 Selection process for appropriately qualified contractors is in accordance with procurement method and project contract

    2021 Competencies:

    Practice Management and Professional Conduct:
    PC 5 Be able to apply essential elements of a client architect agreement across the range of procurement methods in relation to their appropriateness to the scale and type of the project, including alternatives for partial services and the engagement of secondary and sub-consultants. 
    PC 9 Be able to apply contemporary and emerging building procurement methods. This involves identifying the most appropriate form of delivery for a project, including risks, mitigation and adaptation strategies, and integrating appropriate construction contracts and consultancy contracts and/or agreements. 
    PC 11 Be able to assess, recommend and/or select an appropriate procurement process, with consideration for its impact on all phases of a project – including design, documentation and project delivery – and provide advice to the client in terms of the level of scope of service for consultants. 

    Design Delivery and Construction Phase Services:
    PC 48 Be able to select and implement project administration systems, based upon an assessment of the selected procurement method and its implications on project delivery. 
    PC 51 Be able to provide advice to clients and lead (or contribute to) the process of selecting a qualified contractor in accordance with the agreed procurement method and construction contract. 

Learning Outcomes

At the end of this presentation you should be able to:

  1. Understand the different types of building contracts and when to use them
  2. Advise clients on appropriate building contracts to use
  3. Administer the contract from construction start to final certificate
  4. Understand how to balance competing obligations as contract administrator and architect

Brendan is a lawyer with 25 years of experience, with a particular focus on the legal issues relating to property, construction and development. Brendan has extensive experience in all forms of development including commercial, industrial, residential, aged care and retirement, hospitality and public infrastructure. Brendan is highly experienced in the negotiation and drafting of construction contracts and related documents for the development and use of property. Brendan represents clients in a variety of jurisdictions, including the Construction List of the Supreme Court of New South Wales.
