The Institute is offering this course as a proactive response to changes introduced on 1 July 2021 by the NSW Office of Fair Trading under the Design and Building Practitioners Act and Regulation, which seek both to restore consumer confidence in apartment construction, and to safeguard practitioners by improving compliance documentation and declaration practices.

Overview

This presentation guides you through the intent, obligations and process of new compliance documentation requirements for practitioners engaging with Class 2 builds in New South Wales. The Institute is offering this course as a proactive response to changes introduced on 1 July 2021 by the NSW Office of Fair Trading under the Design and Building Practitioners Act and Regulation, which seek both to restore consumer confidence in apartment construction, and to safeguard practitioners by improving compliance documentation and declaration practices.

CPD

This presentation is equivalent to 1 hour/point of formal CPD and will deliver outcomes related to the following Competencies from the National Standard of Competency for Architects:

    2015 Competencies:

    Design: Pre-Design

    2.6 Preparation and analysis of project development options in response to project brief.

    Design: Schematic Design
    4.1 Evaluation of design options in relation to project requirements.
    4.4 Inclusion of expertise of relevant specialists and consultants in developing the project design.

    Documentation: Documentation
    6.1 Identification and adoption of a strategy, program and process of documentation integrated through all project stages to enable project delivery.
    6.4 Timely completion and communication of accurate and comprehensible documents that will include, as required, drawings, models, specifications, schedules and other relevant modes of information.
    6.7 Establishment of quality assurance systems to ensure consistency and completeness of project documentation in accordance with the requirement fo the project brief, project timeframe and project budget.

    Project Delivery: Construction Stage
    8.6 Monitoring project requirements and objectives as described in project documents are met.
    8.7 Identification and application of appropriate and consistent systems for record keeping and maintenance of document revisions.
    8.8 Ensure that warranties, schedules, as built documentation, certificates, approvals and other project information are completed and handed to the client and relevant authorities as required under the contract.  

    Practice Management
    9.7 Knowledge of legal and regulatory requirements and obligations in regard to architectural practice, practice management and registration as an architect.

    2021 Competencies:

    Practice Management and Professional Conduct:
    PC 13 Be able to identify and apply strategies, programming and processes for documentation through all project stages to facilitate project delivery, as appropriate to selected procurement processes. 

    Project Initiation and Conceptual Design:
    PC 24 Be able to prepare and analyse project development options in response to a project brief – its objectives, budget, user intent and built purpose, risk and timeframes, including environmental sustainability considerations. 
    PC 29 Be able to develop and evaluate design options in terms of the heritage, cultural and community values embodied in the site, and in relation to project requirements. 

    Detailed Design and Construction Documentation:
    PC 37 Be able to produce timely, accurate, complete and comprehensible documentation of the design so that it can be constructed. 
    PC 41 Be able to coordinate and integrate input from specialists and consultants into the detailed design and documentation. 
    PC 46 Be able to produce project documentation that meets the requirements of the contract and procurement process and complies with regulatory controls, building standards and codes, and conditions of construction and planning approvals. 
    PC 47 Be able to complete and communicate on-time, accurate documents for relevant stakeholders, including drawings, models, specifications, schedules and construction documentation. 

    Design Delivery and Construction Phase Services:
    PC 48 Be able to select and implement project administration systems, based upon an assessment of the selected procurement method and its implications on project delivery. 
    PC 54 Be able to monitor construction progress and quality as required under the provisions of the construction contract, which may include site visits. 
    PC 55 Be able to apply appropriate and consistent systems for record keeping, document control and revision status during the construction phase. 
    PC 56 Be able to apply appropriate and consistent systems for record keeping, document control and revision status during the construction phase. 
    PC 57 Be able to apply relevant processes required for certification of monetary progress claims, project variations, extensions of time, project instructions, and requests for information, practical completion or other administrative functions explicit in the selected procurement method and associated construction contract.

  1. Explain the public context, the intent, and the importance of increased design documentation as introduced in NSW for Class 2 buildings
  2. Understand how the regulatory responsibilities codified in this new compliance documentation process affect your obligations as a registered architect
  3. Consider ways in which these documentation processes can dovetail into your existing design and documentation protocols
  4. Confidently describe how to fully comply with these new requirements as enacted under the Design and Building Practitioners Act

Many of Laura’s projects involve the compilation, dissemination and negotiation of complex client and user group requirements during the briefing stage and onwards through the life of the project. She achieves this whilst retaining balance and focus on achieving the best outcomes for all involved.

Walter Brindle is a registered architect in NSW and an Associate at JPW. His portfolio of work ranges from small interiors to large city precincts and includes education, public, commercial and residential projects. Walter is also a sessional academic at UTS with a focus on professional practice, an examiner for the board of architects and a NSW Chapter Councillor. Walter is an active member of the NSW professional advocacy committee and has been closely involved in the institute’s engagement with the Office of the Building Commissioner.
